Terms of Service

1. Definitions

• Smart Review / we: the provider of the service (see company details below).
• Customer / you: the business taking out a subscription or ordering hardware. The service is intended for business use.
• Service: the Smart Review software (your own environment with dashboard, redirect links, QR/NFC management and feedback inbox).
• Hardware: physical NFC stickers, cards and stands.

2. The service

After sign-up we automatically provision a private environment for you. You receive credentials by e-mail. The content you collect (links, statistics, feedback) remains yours. Fair use applies: the service is intended for normal business use per location.

3. Fair use and Google policy

Smart Review sends every visitor directly - or via a neutral choice page - to Google; we never ask for a star rating beforehand and never hide the Google option. You may not use the service to filter reviews, collect fake reviews or circumvent the policies of Google or other platforms. We may suspend the service in case of abuse.

4. Account and responsibilities

You are responsible for keeping your credentials confidential and for the accuracy of the data you enter (such as your Google review link). You warrant that you are authorised to represent the business.

5. Subscriptions, prices and payment

Subscriptions are paid monthly or yearly in advance via Mollie (iDEAL, Bancontact, credit card and more). Prices exclude VAT and apply per location as described on the pricing page. Monthly plans can be cancelled monthly; on cancellation you keep access until the end of the current period. Price changes are announced at least 30 days in advance; if you disagree you may cancel before they take effect. If payment fails, your environment may be suspended after a reminder.

6. Hardware orders

Hardware is paid once at the time of ordering and delivered to the address provided. Delivery times are indicative. Unused, undamaged hardware can be returned within 14 days of receipt; NFC tags that have been written and custom items are excluded. Return shipping is at the customer's expense unless the product is defective - in that case we replace it free of charge.

7. Availability and maintenance

We aim for the highest possible availability but do not guarantee uninterrupted operation. Maintenance is announced in advance where possible. We make regular backups of customer environments.

8. Intellectual property

All rights to the software, brand and website remain with Smart Review. You receive a non-exclusive, non-transferable right of use for the duration of your subscription. Your own logos and content remain yours.

9. Privacy and processing

We process personal data as described in the privacy policy. For data you collect through the service (such as private feedback) you are the controller and we are the processor; a data processing agreement is available on request.

10. Liability

Smart Review is not liable for indirect damage (such as lost revenue or reputational damage) or for the content of reviews customers post on external platforms. Our total liability is limited to the amount you paid us in the 12 months before the event causing the damage. Nothing in these terms limits liability for intent or deliberate recklessness.

11. Term and termination

After cancellation the service remains active until the end of the paid period. You can export your data for 30 days afterwards; we then permanently delete the environment. We may terminate the agreement in case of abuse (article 3) or prolonged non-payment.

12. Changes and governing law

We may change these terms; changes are announced at least 30 days in advance. Dutch law applies to this agreement. Disputes will be submitted to the competent court in the Netherlands, after we have first tried to resolve them together.
